These Terms and Conditions (“Terms”) govern your use of our website and the purchase of furniture from Legacy Commercial Furniture ABN: 60 724 110 346 (“we”, “us”, “our”). By accessing our website or placing an order, you agree to be bound by these Terms.
Please read these Terms carefully before making a purchase. If you do not agree with any part of these Terms, please do not use our website or services.
1. Definitions
- “Customer”, “you”, “your” refers to the person or entity purchasing furniture from us
- “Products” refers to furniture, accessories, and related items offered for sale

- “Order” refers to your purchase request submitted through our website, phone, or email
- “Business Day” means Monday to Friday, excluding public holidays in [Your State]
- “Australian Consumer Law” (ACL) refers to Schedule 2 of the Competition and Consumer Act 2010
2. Acceptance of Terms
2.1 Agreement Formation
A binding contract is formed when:
- You submit an order through our website, and
- We send you an Order Confirmation email accepting your order

- We reserve the right to accept or reject any order at our discretion
- If we cannot fulfill your order, we will notify you as soon as possible

3. Eligibility and Account
3.1 Age Requirement
You must be at least 18 years old to purchase from us. By placing an order, you confirm you meet this requirement.

- Colours may vary slightly due to screen settings and photography lighting
- Dimensions are approximate and may vary by ±2cm
- Images may show products with optional accessories not included in base price
4.2 Availability
- Product availability is subject to change without notice
- If an ordered item becomes unavailable, we will:
- Contact you within 2 business days
- Offer a suitable alternative or full refund
- Not substitute without your approval
4.3 Custom and Made-to-Order Items
- Custom furniture is manufactured according to your specifications
- Lead times vary by product (typically 4-12 weeks)
- Custom orders may have different cancellation and return terms (see Section 9)
5. Pricing and Payment
5.1 Prices
- All prices are in Australian Dollars (AUD) and exclude GST unless otherwise stated
- Prices are subject to change without notice
- The price applicable is the price displayed at the time of order confirmation
- We reserve the right to correct pricing errors
- Once an order is accepted, the Purchaser must pay a 50% deposit for the goods and services (unless different payment terms have been agreed upon)
- The remaining amount owed will follow the agreed payment terms. If the Supplier has not offered any payment terms, the full balance must be paid before delivery and/or installation of the goods and services.
5.2 Delivery Charges
- Delivery fees are calculated based on:
- Delivery location (postcode)
- Size and weight of items
- Delivery service level selected
5.3 Payment Methods
We accept:
- Credit cards (Visa, Mastercard, American Express)
- Debit cards
- PayPal
- Bank transfer
5.4 Payment Terms
- Retail customers: Full payment required at time of order
- Business customers: Credit accounts available subject to approval (30-day terms)
- Custom orders: 50% deposit required, balance due before delivery
5.5 Payment Security
- All online payments are processed through secure, PCI DSS compliant payment gateways
- We do not store complete credit card details on our servers
5.6 Failed Payments
If payment fails:
- Your order will not be processed
- We may attempt to contact you for alternative payment
- We reserve the right to cancel orders with failed payments
6. Quotations and Estimates
6.1 Quotation Validity
- Written quotations are valid for 30 days from date of issue
- Prices may change after quotation expiry
- Quotations do not constitute a binding contract until you place an order
6.2 Accuracy
While we strive for accuracy, quotations are estimates and final prices may vary based on:
- Product specification changes
- Delivery location adjustments
- Additional services requested
7. Delivery
7.1 Delivery Areas
We deliver to:
- All Australian states and territories
- Selected regional and remote areas (additional charges may apply)
- Some locations may be excluded (we will advise at time of order)
7.2 Delivery Timeframes
- In-stock items: Typically 5-15 business days
- Made-to-order items: 4-12 weeks depending on product
- Custom items: Confirmed at time of order
- Timeframes are estimates and not guaranteed
- Delays may occur due to circumstances beyond our control
7.3 Delivery Requirements
You must:
- Provide a valid delivery address
- Ensure someone over 18 is present to receive delivery
- Provide access instructions for difficult locations
- Inform us of any access restrictions (stairs, narrow doorways, elevators)
7.4 Delivery Service Levels
- Kerbside delivery: Driver will unload to kerbside only
- Room of choice: Delivery to a room of your choice on ground floor
- Full service: Unpacking, assembly, and packaging removal
7.5 Delivery Notification
- We will contact you 24-48 hours before delivery to confirm
- A 4-hour delivery window will be provided
- If you’re unavailable, re-delivery fees may apply
7.6 Failed Delivery
If delivery cannot be completed due to:
- No one available to receive
- Access issues not previously disclosed
- Incorrect address provided
You will be charged:
- Re-delivery fee (based on original delivery fee)
- Storage fee: $500 per week
7.7 Risk and Title
- Risk transfers to you upon delivery
- Title transfers once full payment is received
- You must inspect goods upon delivery (see Section 8)

8. Inspection and Acceptance
8.1 Delivery Inspection
You MUST:
- Inspect all items immediately upon delivery
- Check for visible damage, defects, or missing items
- Note any issues on the delivery docket
- Take photos of any damage before signing
8.2 Signing Delivery Docket
- Signing confirms you have received the items
- If you sign without noting damage, claims may not be accepted
- If damage is visible, note it on docket or refuse delivery
8.3 Concealed Damage
- Report concealed damage (not visible in packaging) within 48 hours
- Provide photos and order number
- Keep all packaging for inspection
8.4 Reporting Issues

9. Returns, Refunds and Cancellations
9.1 Change of Mind Returns
- You may return items if you change your mind within 14 days of delivery
- Items must be:
- Unused and in original condition
- In original packaging
- With all tags, labels, and documentation
- Return shipping costs are your responsibility
- Restocking fee of 30% applies
- Custom/made-to-order items cannot be returned for change of mind
9.2 Faulty or Damaged Items
- If items arrive faulty or damaged, we will:
- Repair the item, or
- Replace the item, or
- Provide a full refund
- No restocking fee applies
9.3 Cancellations
Before Dispatch:
- You may cancel at any time before dispatch
- Full refund provided (minus payment processing fees if applicable)
After Dispatch:
- Cancellation not possible once shipped
- You may refuse delivery, return shipping costs will apply
Custom/Made-to-Order Items:
- Cancellation only available within 24 hours of placing order
- After 24 hours, no cancellations (manufacturing has commenced)
- Deposit is non-refundable once manufacturing begins
9.4 Refund Processing
- Refunds processed within 5-10 business days of receiving returned item
- Refunded to original payment method
- Allow 3-5 business days for funds to appear in your account

10. Warranties
10.1 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the ACL.
You are entitled to:
- A replacement or refund for a major failure
- Compensation for any other reasonably foreseeable loss or damage
- Repair or replacement if goods fail to be of acceptable quality and the failure does not amount to a major failure
10.2 Manufacturer’s Warranty
- Most products include manufacturer’s warranty (typically 1-5 years)
- Warranty terms vary by product and manufacturer
- Warranty details provided with product or available on request
- Warranty covers manufacturing defects, not normal wear and tear
10.3 Our Warranty Commitment
We warrant that products will:
- Match the description provided
- Be of acceptable quality
- Be fit for their intended purpose
10.4 Warranty Exclusions
Warranties do not cover:
- Damage from misuse, abuse, or neglect
- Normal wear and tear
- Accidental damage
- Unauthorized modifications or repairs
- Damage from improper assembly (if self-assembled)
- Fabric fading from sunlight exposure
- Minor colour variations between batches
10.5 Making a Warranty Claim
To make a warranty claim:
- Contact us with order number and description of fault
- Provide photos showing the issue
- We will assess and advise on next steps
- Keep proof of purchase for all warranty claims
11. Assembly Services
11.1 Professional Assembly (Optional)
- Professional assembly service available for additional fee
- Assembly team will contact you to schedule
- Assembly included: unpacking, assembly, placement, rubbish removal
11.2 Self-Assembly
If you choose to assemble yourself:
- Follow manufacturer’s instructions carefully
- Ensure you have appropriate tools
- Two people recommended for larger items
- We are not liable for damage during self-assembly
- Warranty may be void if incorrectly assembled
12. Care and Maintenance
12.1 Your Responsibilities
To maintain warranty coverage:
- Follow care instructions provided with products
- Clean products using recommended methods only
- Protect from excessive heat, sunlight, and moisture
- Use furniture for its intended purpose only

13. Intellectual Property

- We are not bound by conflicting terms on your PO
18.3 Title Retention
- We retain title to goods until full payment received
- Risk transfers on delivery, but title remains with us
- You must not sell, dispose of, or encumber goods until payment made
